The agreement, in language you can actually read
What you can point checks at, how billing and refunds work, and — the part most terms of service leave out — what we deliberately do not promise.

Draft. These documents describe how pinguHQ actually works today, and they have not yet been reviewed by a lawyer. If something here matters to a decision you are making, ask us before you rely on it: hello@pinguhq.com.
In short
- Only monitor things you own or are allowed to check. This is the rule we enforce hardest.
- Your data is yours. Export it or delete it whenever you like.
- Cancel any time; the plan runs out the period you paid for. Unhappy in the first 30 days and we refund you, no questions.
- There is no uptime SLA in here, because we cannot yet measure and report one honestly. Checks also run from a single region today.
- Alerts are a second pair of eyes, not a guarantee. Do not make us the only safeguard.
1.Who this is between
This agreement is between you — or the company you are signing up on behalf of — and TO CONFIRM — registered entity name, of TO CONFIRM — registered address, which these terms call “we” and “us”. It applies when you create an account, use the dashboard, or use the API.
If you are agreeing on behalf of a company, you are confirming you are allowed to. If you are not allowed to, do not click the button.
The privacy policy and the subprocessor list are part of this agreement.
2.Your account
You need a working email address and you need to be old enough to enter a contract where you live. One person is responsible for each account, even where a workspace has many members.
Keep control of your inbox. Sign-in is by Google or by a one-time link, so whoever can read your email can reach your workspace. Anything done through your account is treated as done by you, unless you tell us it was not.
You decide who joins your workspace and what they can do. Removing someone is your job, and it takes effect immediately.
3.What you are getting
7 kinds of check — HTTP, Ping, Port, DNS, SSL, Keyword, Cron heartbeat — running on the interval your plan allows, incidents that open and close from those checks, alerts to Email, Slack, Webhook, Telegram, and status pages that update themselves.
We describe what exists, and we write down what does not. The roadmap section lists the things we have not built — on-call rotations, SMS and phone alerts, SLO reporting, browser monitoring and the rest. Nothing on the roadmap is part of this agreement, and no plan entitles you to a feature that is on it. If a feature is why you are buying, ask us whether it exists before you pay.
The product changes. We add things, and occasionally we remove things. If we remove or materially reduce something you are paying for, we will tell you by email before it happens, and you can cancel and get back the unused part of what you paid.
4.What you may point it at
A monitoring tool is a request generator, and a request generator aimed at the wrong address is an attack. So this is the rule that matters most:
Only monitor endpoints you own, or that you are authorised to check. If it is a client’s system, you need their permission. Pointing pinguHQ at a third party without it is a breach of this agreement and we will close the account.
You also agree not to:
- use checks as a load test, a stress test, or a way to generate traffic against anyone, including yourself;
- set up monitors designed to interfere with a service rather than observe it;
- attempt to make our workers reach private networks, internal addresses or cloud metadata endpoints. These are blocked at several layers and probing them is treated as an attack on us, not as research;
- publish anything unlawful, deceptive or infringing on a status page you host with us, or use a status page to send bulk mail that has nothing to do with the service it describes;
- subscribe someone to a status page who did not ask for it. Every subscription is confirmed by email, and harvesting addresses into one is not on;
- resell, sublicense or white-label the product beyond what your plan provides for;
- work around plan limits — monitor counts, intervals or projects — with multiple accounts, automation or anything else;
- probe, scrape or interfere with our own infrastructure. Security testing is welcome under the terms on the security page, and not otherwise.
We do not review monitors before they run. We act when something is reported or when it shows up in our own logs.
5.Your data stays yours
Everything you put in — monitors, incidents, status page content, subscriber lists, check history — belongs to you. We claim no ownership of it and no right to use it beyond running the service for you and keeping it working.
You can export it while your account is open, and you can delete it. How long each kind is kept, and what happens when you close the account, is in the privacy policy.
Where you hold other people’s personal data in pinguHQ — status page subscribers, client contacts — you are the controller and we process it on your instructions. A data processing agreement is available at hello@pinguhq.com.
You keep the rights to your logo, your colours and anything else you upload for a status page. You grant us permission to display them on the pages you asked us to serve, and nowhere else.
6.Paying for it
The free plan is genuinely free: no card, no trial clock, and no clause anywhere saying it has to be a hobby project. Commercial use is allowed on it.
Paid plans are billed monthly in advance through Dodo Payments, who act as merchant of record. That means your contract for the payment itself is with them, they handle sales tax and VAT, and your card details are entered on their checkout and never reach us. Prices on the pricing page are exclusive of tax unless stated otherwise; the checkout shows the total before you confirm.
Subscriptions renew each month until you cancel. Cancel any time from the billing settings — the plan runs to the end of the period you already paid for, and then stops. There is no cancellation fee and no notice period.
Upgrades take effect immediately and are charged pro rata for the rest of the period. Downgrades are scheduled for the end of the period you already paid for, and you keep the higher tier until then.
If you end up on a plan that holds fewer monitors than you have, we warn you and then, after seven days, pause the excess — the oldest monitors are the ones that keep running, and a paused monitor is disabled and visible rather than deleted. Go back up a tier and it starts again.
A failed payment is a grace period, not a cut-off: the subscription goes past due and the tier is retained while it is sorted out. If it stays unpaid, the workspace returns to the free plan rather than being deleted, and your data stays where it is.
We may change prices. Existing subscriptions get at least 30 days’ notice by email before a rise applies, and you can cancel before it does.
7.Refunds
If the product does not do what this website says it does, tell us and we will refund you. Within the first 30 days that is unconditional and we will not ask you to justify it.
After 30 days, we refund the unused part of the current period where something on our side went wrong — an extended outage, a feature that turned out not to work as described, a duplicate charge. We do not generally refund a month you used and were happy with and then changed your mind about, and we would rather you cancelled early than left a subscription running unnoticed.
Refunds go back to the original payment method through Dodo Payments, usually within five to ten working days depending on your bank. Ask at hello@pinguhq.com and say what happened; a person reads it.
None of this cuts down statutory rights you have where you live — including EU and UK consumer withdrawal rights, if they apply to you.
8.Availability, and what we do not promise
We work hard to keep this running, and we are not going to print an uptime percentage we cannot yet measure and report on. There is no service level agreement in these terms. If you need contractual uptime commitments, talk to us first rather than assuming them.
Two limitations are worth stating outright, because they are real:
- Checks run from a single region today. A network problem between that region and your service can look like your service being down.
- Monitoring is a second pair of eyes, not a guarantee. Alerts can be delayed or lost by an email provider, a chat platform or a network we do not control. Do not let pinguHQ be the only thing standing between an outage and someone noticing, and do not use it as the sole safeguard for anything where failure causes physical harm or serious financial loss.
We take the service down for maintenance rarely, and we say so on our own status page when we plan to.
9.Suspension and closing accounts
You can close your account at any time, for any reason, without asking us.
We may suspend or close an account that breaches the acceptable use section, that is not paying, or that is putting the service or other customers at risk. Except where the breach is serious or urgent — an attack, a legal demand, monitoring someone else’s systems without permission — we will contact you first and give you a chance to fix it.
If we close your account without cause, we refund the unused part of what you paid. After closure your data is deleted as set out in the privacy policy. Ask for an export before you go, or within 30 days after, and we will help.
10.Warranties and liability
The service is provided as it is. Beyond what this agreement says, and beyond rights the law gives you that cannot be excluded, we make no warranties — no promise that it will be uninterrupted, error free, or that it will catch every failure of every system you point it at.
Neither side is liable for indirect or consequential loss, or for lost profits, revenue, goodwill or data, however it arises.
Our total liability to you for any claim connected with this agreement is capped at the amount you paid us in the twelve months before the claim arose. On the free plan that number is zero, which is the honest consequence of not charging you.
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.
You are responsible for what you monitor. If someone brings a claim against us because you pointed checks at a system you were not authorised to check, or published something unlawful on a status page we host, you will cover the cost of dealing with it.
11.Changes to these terms
We will email account holders at least 30 days before a material change takes effect, and the date at the top of this page moves when the words do. Carrying on using the service after a change means you accept it; if you do not, cancel and we will refund the unused part of the period.
12.Law, disputes and the small print
This agreement is governed by TO CONFIRM — governing law and venue. If you are a consumer, you keep the protection of the mandatory laws of the country you live in.
Before anything formal, email us. Almost everything that looks like a dispute is a misunderstanding that a reply fixes.
If a clause here turns out to be unenforceable, the rest stays in force. Not enforcing something once does not waive it. You may not transfer this agreement without our consent; we may transfer it as part of a sale or reorganisation of the business. Together with the privacy policy and the subprocessor list, this is the whole agreement between us about the service, and it replaces anything said earlier.
Questions about any of it: hello@pinguhq.com.
